Privacy Policy
This Privacy Policy describes how your personal information is collected, used, and shared when you visit, purchase tickets, make donations, or use other services through our website, MCPA.org (the “Site”).
It also describes your data protection rights, including a right to object to some of the processing which Marathon Center for the Performing Arts carries out. More information about your rights, and how to exercise them, is set out in the “What rights do I have?” section.
What personal information do we collect?
Marathon Center for the Performing Arts collects your personal data to manage your relationship with us, allow you to purchase tickets and make donations, issue invoices, and to ensure that we can communicate with you efficiently. Data is shared with third party agents who assist us with payment processing and provision of our services. This may include:
- your name
- your email address
- your phone number
- your address
- your payment details
- information related to the browser or device you use to access MCPA.org
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically collected information as “Device Information.”
We collect Device Information using the following technologies:

- “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

When you make a purchase, donation, or attempt to make a purchase or donation through our e-commerce point of sale, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information.”
When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.
When visitors make an inquiry through a form on this website, the data shown in the form is stored on this website along with the visitor’s IP address and browser user agent string to help spam detection. This enables MCPA staff to both view and respond to visitors and their inquiries.
How do we use your personal information?
We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
- Fulfill ticket orders and donations;
- Communicate with you;
- Screen our orders for potential risk or fraud;
- View and respond to inquiries and information you submit; and
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services and those of our presenting partners.
We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).
Sharing your personal information
We share your Personal Information with third parties to provide services and communications, as described above. For example, we use Salesforce and PatronManager to power our online box office. Marathon Center for the Performing Arts follows generally accepted industry standards to protect the personally identifiable information submitted to us, both during transmission and once we receive it. Sensitive information (such as credit card numbers) are encrypted using secure socket layer technology, and we maintain compliance with PCI DSS (Payment Card Industry Data Security Standard). No method of transmission over the Internet, or method of electronic storage, is 100 percent secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
Withdrawing consent or otherwise objecting to direct marketing
Wherever we rely on your consent, you will always be able to withdraw that consent, although we may have other legal grounds for processing your data for other purposes, such as those set out above. In some cases, we are able to send you direct marketing without your consent, where we rely on our legitimate interests. You have an absolute right to opt-out of direct marketing, or profiling we carry out for direct marketing, at any time. What rights do I have?
You have the right to ask us for a copy of your personal data; to correct, delete or restrict (stop any active) processing of your personal data; and to obtain the personal data you provide to us for a contract or with your consent in a structured, machine readable format, and to ask us to share (port) this data to another controller.
In addition, you can object to the processing of your personal data in some circumstances (in particular, where we don’t have to process the data to meet a contractual or other legal requirement, or where we are using the data for direct marketing).
These rights may be limited, for example if fulfilling your request would reveal personal data about another person, or if you ask us to delete information which we are required by law to keep or have compelling legitimate interests in keeping.

Data Retention
When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.
Where we process personal data for marketing purposes or with your consent, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests). We also keep a record of the fact that you have asked us not to send you direct marketing or to process your data so that we can respect your request in the future.
Where we process personal data in connection with performing a contract, we keep the transactional data for six years from your last interaction with us (or such longer period as may be required by law).
Changes
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
